# Terms of Use — Montweel (montweel.com)

These terms apply to the Mont SDK, Gateway and Dashboard (Community Edition and Commercial/Pro License) published by Montweel (montweel.com).

## 1. "AS-IS" & "AS-AVAILABLE" Software Disclaimer

The Mont SDK, Gateway and Dashboard are self-hosted software tools provided strictly "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, or non-infringement.

## 2. Zero Liability for Deployment, Usage & Security Breaches

You assume 100% responsibility for configuring, deploying, securing and monitoring the SDK in your environment. Under no circumstances shall Montweel, its creator or contributors be liable for any direct, indirect, incidental, consequential or punitive damages—including but not limited to unauthorized API access, security breaches, prompt injection bypasses, data loss, runaway upstream API charges, financial losses or business interruption—arising from the deployment or use of the software.

## 3. Not a Substitute for Upstream Security

Mont operates as a governance and traffic-management layer. You remain solely responsible for securing your underlying network, servers, authentication tokens and upstream application logic.

## 4. No SLA & No Guarantee of Updates

Neither the Community Edition nor the Commercial/Pro License includes any Service Level Agreement (SLA), uptime guarantee or mandatory maintenance commitment. Software updates, bug fixes and new features may or may not be provided at the sole discretion of Montweel.

## 5. Limited Best-Effort Support

Support via support@montweel.com is provided on a limited, best-effort basis only, with no guaranteed response or resolution timeframes.

## 6. Liability Cap

In any jurisdiction where liability cannot be completely excluded, total cumulative liability shall never exceed the lesser of the amount actually paid by you for the license in the preceding three (3) months or USD $30.00.

## 7. Intellectual Property Rights

All copyrights, trademarks, trade secrets, patents and other intellectual property rights in the Mont SDK, Gateway, Dashboard and the Mont name and logo remain the exclusive property of Montweel. No rights are granted except the limited right to use the software under these terms and your applicable license.

## 8. Open-Source & Third-Party Attribution

The software incorporates open-source libraries (such as Node.js, Express and SQLite) that are licensed to you under their own respective permissive licenses. Those licenses continue to apply to those components, and nothing in these terms restricts your rights under them.

## 9. Export Controls & Compliance

You agree to comply with all applicable local and international export control, sanctions and other laws and regulations that apply to the deployment and use of the software.

## 10. Governing Law & Jurisdiction

These terms are governed by the laws of India. The courts at Pune, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or the software.

## 11. Severability

If any provision of these terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

## 12. Entire Agreement

These terms constitute the entire agreement between you and Montweel regarding the software and supersede all prior understandings on that subject.
